A spokesman for one consumer organisation has spoken out about new legislation that aims to protect people in the market for new handsets - including those recycling mobile phones.

Shoppers looking to replace an older model like the Sony Ericsson K800i may welcome the changes, which aim to ensure people are not mis-sold packages with false information about charges, coverage and cashback schemes.

Commenting on the Ofcom regulatory change, Nick Hutton of Consumer Focus said the move would be a good thing for the industry and could help instil confidence in buyers.

"The risk of incurring a hefty fine should deter unscrupulous operators from poor sales practices and should also encourage mobile network operators to police unscrupulous third parties," he added.

Ofcom said this week that companies found to be in breach of the revised regulations could be facing fines of up to ten per cent of their relevant turnover.
