Apple Seeks Clarification Over Patent Rules

Apple has asked for further clarification over how patents deemed essential to industry standards should be handled for new mobile phones in a letter written to the European Telecommunications Standards Institute.

The firm wrote the correspondence in November and called for "more consistent and transparent" application of rules designed to ensure such certain intellectual properties are properly licensed, the Wall Street Journal reported.

It centres on the Frand principles, which is an agreement to licence technologies that are deemed essential for all mobile phones under fair, reasonable and non-discriminatory terms.

Ilya Kazi from the UK's Chartered Institute of Patent Attorneys said: "The issue is whether this letter has a great deal of legal significance. Frand is a great principle but there is also the underlying principle of letting patent holders enforce their rights."

Apple was recently forced to pull its iPads and iPhones from its stores in Germany following Motorola Mobility enforcing a patent injunction against its rival.
