Apple false advertising claim against Amazon Appstore dismissed
Amazon did not breach false advertising regulations when using the name Appstore, Judge Phyllis Hamilton has ruled.
Mobile phone manufacturer Apple made this claim about the online retail giant, arguing that customers would associate the reputation of its own App Store with the service.
However, the US arbitrator decided that, since downloads from its virtual shop are only available through iPhone handsets whereas Amazon's are only compatible with Android gadgets, consumers would not be misled.
The decision to dismiss this allegation should not impact on verdicts regarding alleged trademark infringements.
Apple's App Store has more than 700,000 tools and games, such as Angry Birds, Facebook and Skype, available for installation.
Android handset owners would normally use Google Play, but can choose to download the Amazon Appstore and take advantage of the Free App of the Day service.
Users will also be provided with personalised recommendations each time they access the tool, helping them to find hidden gems.
